Terms of Service

Stacked provides realtime Fibonacci and Modified Fibonacci estimation rooms for agile teams. Hosts can create sessions, invite guests via a shared link, and run voting rounds. We may modify or discontinue any part of the Service with reasonable notice.

Must be 18 or older to create a host account.

You are responsible for account security. Notify legal@brightstack.us immediately of any suspected unauthorized access.

Provide accurate, current, complete information.

You agree NOT to:

• Use the Service for unlawful purposes.
• Harass, abuse, or spam other participants.
• Impersonate any person.
• Gain unauthorized access.
• Reverse engineer the Service.
• Use automated scraping tools without written consent.
• Upload illegal, harmful, or infringing content.
• Interfere with Service infrastructure.

Violations may result in immediate termination.

You retain ownership of your content (session names, story titles, comments). You grant us a limited license to host, display, and transmit it to operate the Service.

You may not upload unlawful, harmful, or infringing content.

Guests may join sessions without creating an account. Guests are bound by these Terms with respect to their behavior in a session. Hosts control who remains in a room and may remove participants.

The Service and its content (excluding your content) is owned by Michell + Marteen LLC and protected by intellectual property laws. No trademark or branding rights granted.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MICHELL + MARTEEN LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS PAID IN THE PRIOR 12 MONTHS.

You agree to indemnify Michell + Marteen LLC from claims arising from your use of the Service, your content, or your violation of these Terms.

We may suspend or terminate accounts for violations or with reasonable notice. You may delete your account at any time. Sections 4, 6, 7, 8, 9, 11, and 12 survive termination.

Governed by Texas law. Disputes resolved by binding arbitration in Harris County, Texas under AAA Commercial Arbitration Rules. Class action waiver applies. Either party may seek injunctive relief in any competent court.
